TERMS AND CONDITIONS OF SALE
The sales of any goods by Baronius Press Ltd (company registration number: 011242V, VAT Registration Number: GB004473506, registered in Isle of Man, registered and trading office: St Mary’s, The Parade, Castletown, IM9 1LG, Isle of Man) shall be subject to the following Terms and Conditions ("Terms"). Nothing in these Terms shall affect a customer's statutory rights as a consumer.
1. FORMATION OF CONTRACT OF SALE
(a) The prices stated on this website are either in United States dollar ($, USD) for orders to the USA and Canada or in British pound sterling (£, GBP) for order to the United Kingdom and Europe.
(b) If you wish to purchase any items on this website, you must submit a completed order form. Your order will not be accepted unless you place us in a position of being able to receive full payment for your order at the time we accept it. If we agree to accept your order, we will confirm this by email, then supply the items you have ordered to you in accordance with these Terms. We reserve the right not to accept an order placed by you, in which case you will be notified within 2 business days of receipt of order.
(c) The sale and purchase of products via this website will be governed by a contract between you and us formed when you have placed an order, your order has been accepted by us and we have sent you confirmation of this (the "Contract"). The terms of the Contract will comprise these Terms, as amended or updated by us from time to time, and other relevant information.
(d) You acknowledge and agree that, in entering into a Contract, you do not rely on and have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to the Contract or not) which is not expressly set out or referred to in the Contract.
2. SHIPPING POLICIES
(a) General Shipping Information
All delivery times are quoted in business days which exclude Saturdays, Sundays and Public Holidays and start from the next day after the shipment date. Shipments to certain locations may require additional time in transit. Orders for USA and Canada are shipped from our warehouse in Pennsylvania (USA) or Virginia (USA), orders for United Kingdom and Europe are shipped from our warehouse in East Sussex (UK).
USA — USPS orders must be received by 11.00 a.m. EST and UPS orders by 1:00 p.m. EST for same day shipment. All orders submitted after those times will be processed the next business day. UPS delivery is not available to U.S. post office boxes or APO/FPO addresses. All standard deliveries to a domestic P.O. Box or APO/FPO address must be shipped via USPS. You will need to select 'USPS Media Mail' as the delivery option for the order to be processed and shipped. The tracking number for your order will be automatically emailed to you within 24 hours of the order shipment.

- UPS Ground — Delivery within one to five business days
- UPS 3 Day Select — Delivery by the end of the third business day
- UPS 2 Day Air — Delivery by the end of the second business day
Canada — Orders must be received by 11.00 a.m. EST for same day shipment. Orders up to 4lbs are shipped via USPS First Class Mail International which generally take between 7–21 days to arrive, although the USPS does not guarantee delivery dates or times. Orders above 4lbs are shipped by USPS Priority Mail International with USPS quoted delivery times of 6 to 10 days although the actual number of days may vary based on origin, destination, and customs delay, see USPS website for more details. The tracking number for your order will be automatically emailed to you within 24 hours of the order shipment.
United Kingdom, 1-2 Days Service — Orders must be received by 11.00 a.m. GMT for same day shipment. We select the delivery service and carrier based on the delivery address, the value of your order and the carrier coverage from the following services: Royal Mail Tracked 24/48, Yodel 24/48 or DPD Next Day. Tracking number can be emailed upon request.
Europe — Orders are sent from our United Kingdom warehouse and must be received by 11.00 a.m. GMT for same day shipment. Orders are shipped by a courier and we are unable to provide the ETA for your order. Tracking number can be emailed upon request. (Please note that Europe contains only selected European countries, those covered by our custom tariff with our couriers.)
(b) Delivery Address and Contact Details
Please ensure that you provide us with correct delivery address and contact telephone number for your order. We cannot be held liable for the loss if your order is lost or not delivered due to incorrect delivery address. If your order is returned to us because of a wrong address supplied by you, we will make reasonable effort to contact you and rectify the situation. If you choose to have the order shipped again, you will be billed the appropriate shipping and handling charge. If you choose to cancel the order you, we will deduct from the amount to be refunded up to £7/$10 restocking fee and the incurred shipping and the handling charges for your order. If your order is returned to us because you refused the delivery, you will be charged £7/$10 restocking fee and your shipping and handling charges will not be refunded.
(c) Lost or Damaged International Shipments (Europe, Canada)
We properly package, label and record all orders. Please understand that after an order is handed to the shipping carrier, we have no control over it. Final delivery of international orders is handled by the postal/courier services of the recipient's country. You agree that the international shipping of your order is solely your responsibility and at your own risk once the order is handed to the shipping carrier. You also agree to forfeit any rights to refund of your order and shipping and handling cost should your order get delayed, lost or damaged.
(d) Customs, Duties and Taxes on International Orders (Europe, Canada)
International orders may be subject to the receiving country’s import fees, duty, taxes and/or brokerage fees. You are considered the importer of goods and must comply with all laws and regulations of the country in which you are receiving the goods. Any such charges are to be borne by you, i.e. we are not responsible for any import fees, duty, taxes, brokerage fees etc. charges you may incur. Parcels are marked with the value of the content as paid by you in legal accordance with international shipping regulations. Please contact your local customs office before completing the order to find out what fees, if any, may be charged when your package arrives. If your order is returned to us because of a refusal to pay import fees, duty, taxes and/or brokerage fees you will be charged £7/$10 restocking fee and your shipping and handling charges will not be refunded.
3. RETURN POLICY
Upon receipt of your order please open the package immediately and check its contents. If you ordered an item by mistake or received a wrong item, please DO NOT REMOVE THE SHRINK WRAPPING as you may invalidate your right to return the item. All titles with gold gilded pages must be returned unopened for a refund or exchange, see Section (g) below. All of our titles can be easily identified either through its cover, back blurb sheet or paper wrap, therefore there is no need to remove the shrink wrapping.
(a) If an item is damaged you must keep the original shipping container and packing materials. If you need to exchange or file a claim for damages or obtain replacements for defective items you are required to notify us within 10 days of receipt of delivery. Do not send any product back without prior approval. If you return an item without prior approval you may be liable for £10/$15 administration fee in addition to shipping charges.
(b) All goods ordered in error, whether already shipped or pending shipping, may be subject of up to £7/$10 re-stocking fee. This fee covers administration time, credit card processing and refunding fees and is only applicable to the goods. Shipping and handling charges are refundable in full, except when goods have been shipped. There are no exceptions to the re-stocking charge. We will issue a refund within 1-3 working days after your cancelation has been acknowledged.
(c) Contact us via our 'Email Enquiry Form' at www.baroniuspress.com/ContactUs with the following information:
- Your Name
- Your Order Number
- Product Name (if you purchased more than one item)
- Description of what the problem is
- What you would like done
For Orders made through Amazon Marketplace, you will need to send us a formal Return Request via Amazon.
(d) Once your request is authorized, you will be issued with Return Form (RMA) that will need to be printed and included with the returned item(s). At that time you may be asked to ship the product back to us. We reserve the right to determine the return method.
(e) Items in its original condition, i.e. unopened in its shrink wrapping
If an item is being returned to us due to no fault on our part, you will be responsible for returning the item to our warehouse at your expense. We will also deduct the order's postage cost and a restocking fee of up to £7/$10 from the amount that you have paid.
(f) Used Items (opened and/or taken of its shrink wrapping)
If your item has been opened/used but still in pristine condition and you decide to return it to us for any reason, please note that we will charge a restocking fee which will depend on how much wear and tear the book has undergone. We will also deduct the handling and shipping cost we incurred to send out your order. You will also be responsible for returning the item to our warehouse at your expense. Please note that we reserve the right to refuse returns on opened/used items.
(g) Note on books with gilded pages.
Once books with gilded pages are removed from their shrink-wrapping and their pages opened (even if only once), they can no longer be resold because the gilding will have been broken. If you ordered an item by mistake or received the wrong item, please do not remove the shrink wrapping. All of our gilded books come with paper flaps/wraps that clearly identify the title, therefore there is no need to remove the shrink wrapping.
(h) We reserve the right to make the final decision on the condition of the goods. We will issue the refund to your account (card) within 1-3 working days of the receipt and examination of the returned item(s).
(i) Cooling-off Period (United Kingdom orders)
Under the Isle of Man and United Kingdom legislation (Distance Selling Regulations), you have the right to cancel your order for up to 14 days from the day after that on which the order is received by you. To cancel your purchase within the "cooling off" period, please contact us via our 'Email Enquiry Form'.
You agree that you you will contact us first to clarify any charges made by Baronius Press on your payment card or to resolve any issues (i.e. delivery, quality, refund) you may have before filing a chargeback with your payment card provider. Should you file a chargeback without contacting us first and we succesfully defend your claim, you agree that you will reimburse Baronius Press any chargeback fees levied upon us by our card payment processor and our fee of $35 for having dealt with your chargeback claim.
5. LIMITATION OF LIABILITY
You acknowledge and agree that, in no event, shall Baronius Press be liable, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, for any indirect, special, punitive, exemplary, incidental or consequential loss, damage, cost or expense of any kind whatsoever, howsoever caused, or for any loss of production, cost of procurement of substitute goods, loss of capital, loss of software, loss of profit, loss of revenues, contracts, business, cost of rework, loss of goodwill or anticipated savings, or wasted management time, even if Baronius Press has been advised of the possibility or they are foreseeable. Baronius Press' total liability on all claims, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, shall not exceed the purchase price of goods or content.
7. CHANGES AND UPDATES
Baronius Press Ltd reserves the right to modify or amend these Terms at any time by posting the revised Terms on our website. Please review these Terms regularly to ensure you are aware of any changes made by us.
8. MATTERS BEYOND REASONABLE CONTROL
Neither party is liable for any breach of this Agreement that is caused by a matter beyond its reasonable control, including acts of God, fire, lightning, explosion, war, flood, industrial disputes, sabotage, extremely severe weather, or acts of local or central Government or other competent authorities.
9. GOVERNING LAW AND JURISDICTION
Any sales contract entered into by this website shall be governed under the laws of Isle of Man where it is hereby agreed, that the proper jurisdiction and venue is these said courts in any legal action or proceedings.
