TERMS AND CONDITIONS OF SALE

The sales of any goods by Baronius Press shall be subject to the following Terms and Conditions (“Terms”). Nothing in these Terms shall affect a customer's statutory rights as a consumer.


1. FORMATION OF CONTRACT OF SALE

(a) If you wish to purchase any items on this website, you must submit a completed order form. Your order will not be accepted unless you place us in a position of being able to receive full payment for your order at the time we accept it. If the payment transaction for your order is placed in the 'Review State' by Fraudshield it will require manual approval. Please note that this may take up to 2 business days. If we agree to accept your order, we will confirm this by email, then supply the items you have ordered to you in accordance with these Terms. We reserve the right not to accept an order placed by you, in which case you will be notified within 2 business days of receipt of order.

(b) The sale and purchase of products via this website will be governed by a contract between you and us formed when you have placed an order, your order has been accepted by us and we have sent you confirmation of this (the "Contract"). The terms of the Contract will comprise these Terms, as amended or updated by us from time to time, and other relevant information.

(c) You acknowledge and agree that, in entering into a Contract, you do not rely on and have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether party to the Contract or not) which is not expressly set out or referred to in the Contract.


2. PREORDERS

(a) Baronius Press accepts advance orders ("Preorders") for items that are not yet published. Please note that your account will be debited immediately on receipt of your order.

(b) The due in date is displayed on the order page, however this is an approximate date and Baronius Press reserves the right to alter this date, to reflect the most accurate date of availability.

(c) If your Preorder is part of a larger order, you will have the choice of selecting your prefferd shipping method. If you select the "Ship Separately" option for your order, we will ship your order in two parts - the items in stock immediately and the preordered titles when they arrive in stock. You will be charged postage as if you made two separate orders. If you select the "Ship Together" option for your order, we will reserve the titles currently in stock and ship it together with the preordered titles when they arrive in stock. You will be charged postage for one order.


3. SHIPPING POLICIES

(a) General Shipping Information
All delivery times are quoted in business days which exclude Saturdays, Sundays and Public Holidays. Shipments to certain locations may require additional time in transit. Orders for USA, Canada the Rest of the World are shipped from our warehouse in Pennsylvania (USA), order for UK and Europe are shipped from our warehouse in Essex (UK).

USA — USPS orders must be received by 11.00 a.m. EST and UPS orders by 2:30 p.m. EST for same day shipment. All orders submitted after those times will be processed the next business day. UPS delivery is not available to U.S. post office boxes or APO/FPO addresses. All standard deliveries to a domestic P.O. Box or APO/FPO address must be shipped via USPS. You will need to select 'USPS Media Mail' as the delivery option for the order to be processed and shipped.

  • USPS Media Mail — 2-10 days
  • UPS Ground — Delivery within one to five business days
  • UPS 3 Day Select — Delivery by the end of the third business day
  • UPS 2 Day Air — Delivery by the end of the second business day

Tracking number is not available for USPS shipments, however, all USPS shipments are sent with Delivery Confirmation. You will be emailed the USPS Delivery Confirmation Number or UPS Tracking Number upon request.

Canada — Orders must be received by 11.00 a.m. EST for same day shipment. Orders are shipped by USPS First-Class Mail International for packages up to to 4lbs and USPS Priority Mail Flat Rate Box for orders between 4lbs-20lbs. The inside dimensions of the two boxes available for USPS Priority Mail Flat Rate are 11" x 8.5" x 5.5" and 13.625" x 11.875" x 3.375". Should your order not fit either of the two boxes, your order will be put on hold and you will be contacted by email with a sugegstion for alternative method of shipping.

UK — Orders must be received by 1.00 p.m. GMT for same day shipment.

  • Royal Mail (1st class) — First Class mail aims to deliver your letter or packet the next working day, including Saturday. (Source: www.royalmail.com) Packages sent through Royal Mail are not tracked, therefore we are unable to provide updates about the location of your package once it has shipped.
  • DHL 1-2 Day Service (with POD*) — Delivery times are Monday - Friday between 9.00am and 5.30pm. Please kindly ensure that there is someone to receive the parcel at the delivery address. If no one is available, DHL will leave a card for you to arrange re-delivery. If you feel that this may be a problem, we recommend that you use your work address as the ‘delivery address’. * POD - Proof of Delivery

Europe* — Orders are sent from our UK warehouse and must be received by 1.00 p.m. GMT for same day shipment. Orders are shipped by DHL. Tracking number can be emailed upon request.

Rest of the World — Orders are sent from our US warehouse must be received by 11.00 a.m. EST (4.00 p.m. GMT) for same day shipment. Orders are shipped by USPS Express Mail International–Signed For. Please note that this is not a courier service and therefore we are unable to provide updates about the location of your package once it has shipped.

* Please note that Europe contains only selected European countries, those covered by a DHL shipping service. The European countries not listed here can be found in the Rest of the World category.

(b) Shipping Address
Please ensure that you provide us with correct shipping address for your order. We cannot be held liable for the loss if your order is lost or not delivered due to incorrect shipping information.

If your order is returned to us because of a wrong address supplied by you, we will make reasonable effort to contact you and rectify the situation. If you choose to have the order shipped again, you will be billed the appropriate shipping charge. If you choose to cancel the order you will be charged a £5/$10 restocking fee and your shipping charges will not be refunded.

(c) Lost or Damaged International Shipments (excluding UK and USA)
We make every effort to properly package, label and record foreign shipments. Please understand that after an order leaves the USA we have no control over it. Final delivery of international orders is handled by the postal service of the recipient's country. On rare occasions an international order may get lost or damaged. We cannot be held responsible for the loss or damage of a package once it leaves our store for an international destination.

(d) Customs, Duties and Taxes
Orders sent to addresses outside of the European Union may be subject to import duties and taxes, which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you, as these vary from country to country, and we are not able to provide you with this information. Please contact your local customs office before completing the order to find out what fees, if any, may be charged when your package arrives. Please note that you are considered the importer of goods and must comply with all laws and regulations of the country in which you are receiving the goods. Customs authorities may require the value of the order from us.


4. RETURNS

(a) Baronius Press Ltd is committed to 100% customer satisfaction. Upon receipt of your order please open it immediately and check it. If an item is damaged you must keep the original shipping container and packing materials. If you need to exchange or file a claim for damages or obtain replacements for defective items you are required to notify us within 10 days of receipt of delivery. Do not send any product back without prior approval. If you return an item without prior approval you may be forfeiting the shipping expense you incurred. Contact us via our 'Email Enquiry Form' on the Contact Us page with the following information:

  • Your Name
  • The Order Number
  • The Product Description
  • Description of what the problem is
  • What you would like done

We will contact you as to the disposition of the product and of the shipping container. At that time you may be asked to ship the product back to us. We reserve the right to determine the return method.

(b) Cooling-off Period
By law, customers in the European Union also have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered.

To cancel your purchase within the seven-working-day cooling-off period, please contact us via our 'Email Enquiry Form' on the Contact Us page, giving the reason for the return. Please package the relevant item(s) in their original shipping container and send it to us, so that we receive it within seven working days of the day after the date that the item was delivered to you. For your protection, we recommend that you use a recorded-delivery service. Please note that you will be responsible for the costs of returning the item(s).

Item(s) MUST be in good condition for resale. We reserve the right to make the final decision on the condition of the product. As soon as we receive the returned item(s) of your cancellation, we will refund the relevant part of the purchase price for that item together with the item's usual postage charge.

5. CANCELLATIONS

All goods ordered in error, whether already shipped or pending shipping, are subject to a £8/$15 re-stocking fee. This fee covers administration time, credit card processing and refunding fees and is only applicable to the goods. Delivery charges are refundable in full, except when goods have been shipped. There are no exceptions to the re-stocking charge


6. LIMITATION OF LIABILITY

You acknowledge and agree that, in no event, shall Baronius Press be liable, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, for any indirect, special, punitive, exemplary, incidental or consequential loss, damage, cost or expense of any kind whatsoever, howsoever caused, or for any loss of production, cost of procurement of substitute goods, loss of capital, loss of software, loss of profit, loss of revenues, contracts, business, cost of rework, loss of goodwill or anticipated savings, or wasted management time, even if Baronius Press has been advised of the possibility or they are foreseeable. Baronius Press’ total liability on all claims, whether in contract, warranty, tort (including negligence or breach of statutory duty), strict liability, indemnity, contribution, or otherwise, shall not exceed the purchase price of goods or content.


7. PRIVACY POLICY

8. CHANGES AND UPDATES

Baronius Press Ltd reserves the right to modify or amend these Terms at any time by posting the revised Terms on our website. Please review these Terms regularly to ensure you are aware of any changes made by us.


9. MATTERS BEYOND REASONABLE CONTROL

Neither party is liable for any breach of this Agreement that is caused by a matter beyond its reasonable control, including acts of God, fire, lightning, explosion, war, flood, industrial disputes, sabotage, extremely severe weather, or acts of local or central Government or other competent authorities.


10. GOVERNING LAW AND JURISDICTION

Any sales contract entered into by this website shall be governed under the laws of England & Wales where it is hereby agreed, that the proper jurisdiction and venue is these said courts in any legal action or proceedings.
